XTRA Airways: Suit has no merit
XTRA Airways insists that the claims made by Dream Pacific Aviation Services Hong Kong Ltd. in its racketeering lawsuit against XTRA are false and without merit.
AerSale Inc. director of marketing Lyndelle Nieuwkerk told Saipan Tribune that Dream Pacific failed to honor its contractual commitments to XTRA Airways.
AerSale Inc. reportedly operated and controlled XTRA Airways.
Nieuwkerk said in an email that XTRA Airways ultimately canceled its agreement with Dream Pacific after XTRA Airways was not paid for the flights it was contracted to fly for Dream Pacific.
The marketing director said XTRA Airways will file a response to Dream Pacific’s lawsuit with the U.S. District Court for the NMI at the appropriate time and will be claiming damages against Dream Pacific.
“XTRA Airways will vigorously defend the false allegations contained in the lawsuit through the court process,” Nieuwker said.
Dream Pacific and four other businesses, along with 21 Chinese tourists, have filed a $50-million racketeering lawsuit in federal court against the owner and officials of XTRA Airways and several others, including AerSale Inc., for allegedly engaging in a fraudulent scheme by pretending to participate in a plan to bring vacationing tourists from China to Saipan via charter flight but in fact deliberately sabotaging such plan by failing to take the steps necessary for it to succeed.
