XO Market sued for breach

The owner of the building that XO Market occupies is suing the grocery store’s owners for refusing to vacate the premises, nearly eight months after the termination of their lease.

D.S. Corp. and Eo Dae Sun have filed a civil case against Li Guo Wu and Long Feng Corp., which operates the XO Market, for stubbornly refusing to vacate the building and for failing to pay rent.

D.S Corp. wants XO Market removed from the building at once.

According to the complaint, D.S. Corp. leased the commercial building space on Middle Road in 2010 to Long Feng Corp. so it could establish the XO Market.

The extended lease came to an end back in Dec. 31, 2017, and Long Feng Corp reportedly refuses to move out nearly eight months later.

D.S. Corp has taken legal action before through the Holdover Tenancy Act but Long Feng Corp. has yet to be removed and D.S. Corp. said it has already lost a new tenant as a result of Long Feng’s “trespassing.”

D.S. Corp. has filed the lawsuit to hold the Long Feng Corp. and Wu Guo accountable for the loss of possible revenue as a result of their contract breach and more.

D.S. Corp. is alleging breach of contract, trespassing, conversion, unjust enrichment, breach of the Holdover Tenancy Act, and Injunctive Relief.

The lawsuit was filed on Aug. 13, 2018 and D.S Corp. is demanding a trial by jury.
