Worker sues for injuries from fall

A construction worker has filed a lawsuit against his former employer after he was injured when he fell down from a 10-foot ladder at the Rota Health Center.

Jose T. Yumul, through counsel Juan T. Lizama, sued Radiocom Saipan Inc. for negligence and is demanding unspecified damages.

Saipan Tribune tried but failed to get comments from Radiocom yesterday.

Lizama stated in the complaint that Yumul was assigned by Radiocom, through a supervisory employee, to erect a high-rise antenna on the roof of Rota Health Center on July 8, 2010.

While climbing up the ladder, Yumul allegedly fell down to the building’s concrete rooftop, fracturing his left wrist, arm, and hip. Yumul was required to undegro surgery, Lizama said, and that he continues to receive medical care and treatment to include physical therapy.

“Since the fall, the plaintiff has been unable to work because of the pain that he has suffered from the fall,” Lizama said.

Lizama said that prior to climbing the ladder, Radiocom did not give Yumul any protective equipment and did not provide safety training and education in the recognition, avoidance, and prevention of unsafe conditions.
