Sexual abuse charges against teacher dismissed

Superior Court Associate Judge Joseph N. Camacho on Friday dismissed the charges against Kenn Litulumar Aldan, a 42-year-old teacher accused of sexually abusing a minor girl that is autistic.

At a preliminary hearing, Camacho found no probable cause to believe that the crimes of sexual abuse of a minor in the second degree, assault and battery, and disturbing the peace were committed.

Camacho dismissed the charges without prejudice, meaning that the government can bring the charges if and when they are able to obtain more evidence.

The judge said at best, the prosecution has shown an alleged victim who has been coached to say she was sexually abused in order for Aldan to transfer all of his property.

Camacho said the tactic of the mother of the alleged victim to leverage bringing sexual charges to obtain property takes away from all the legitimate cases and victims who need and deserve help.

Aldan was accused of sexually abusing two minor girls and inappropriately touching the private parts of two minor boys. The Office of the Attorney General elected to file charges only with respect to the 16-year-old girl.

At a preliminary hearing on Friday, Camacho said the mother of the alleged victim gave Aldan an ultimatum to transfer all of his property to one of her children.

She gave Aldan a week of ultimatum to such transfer or else she would report to police that he was molesting the children.

Camacho said the alleged victim is 16 years old and is homeschooled and highly susceptible to suggestions, and only responds to questions in short broken sentences.

Camacho said police interviewed the alleged victim, who provided conflicting stories—as the incident happened on “Feb. 7 or 20 or maybe April 8.”

The judge said the law is very clear—the Constitution requires probable cause to bring the charges.

“Probable cause is evidence which amounts to more than a bare suspicion but less than evidence that would justify a conviction. For a conviction at a trial, proof beyond a reasonable doubt is required,” Camacho said.
