Sentencing for charcoal-maker rescheduled

The sentencing for Mizanur Khan, the part-owner of a company that makes charcoal, has been pushed back to a later date to give the defense more time to review the presentence report and submit any objections they may have.

Defense lawyer Colin Thompson asked the U.S. District Court for the NMI for more time to file any objections to the U.S government’s presentence investigation report for Khan. His motion was unopposed.

Chief Judge Ramona Manglona granted the extension last Friday.

Manglona ordered Thompson to submit his objections on or before July 15, giving him enough time to review the presentence investigation report and to confer with his client.

The sentencing hearing for Khan has been moved from July 1 to Aug. 30 at 9am.

According to an online source, a presentence investigation report is an investigation into the history of a person who has been convicted of a crime. A judge can determine the severity of the punishment to be imposed by using this report.

Assistant U.S attorney Eric O’Malley represents the U.S government in the case while Thompson represents Khan.

According to Saipan Tribune archives, Khan pleaded guilty back in January to count two of the indictment charging him with fraud and misuse of a visa.

Visa fraud carries a maximum penalty of not more than 10 years of imprisonment and a fine not to exceed $250,000.

In exchange for Khan’s guilty plea, the U.S. government agreed to recommend a sentence of five months and to dismiss the remaining count of the indictment upon sentencing.

Khan and his business partner allegedly engaged in fraud in the applications for CNMI-Only Transitional Worker program permits.

Khan’s business partner and co-defendant, Kosuke Tomokiyo, pleaded guilty to count four of the indictment charging him with fraud and misuse of visas and permits.

Tomokiyo has since been sentenced to one-year probation.
