Reksid objects to his sentencing

Franz B. Reksid, a former Department of Public Lands special assistant to the secretary, is objecting to going ahead with his sentencing today, Tuesday, in federal court.
Reksid, 71, through counsel Mark B. Hanson, said the U.S. Probation Office has not provided the final presentence report with the addendum and comments as required by Federal Rules of Criminal Procedure.
Hanson said that Federal Rules 32(6) requires that the U.S. Probation Office submit to the court and to the parties at least seven days before sentencing the presentence report.
Hanson said the Probation Office filed an initial presentence report with the court and served the parties on March 19, 2012.
The lawyer said that within the extensions of time granted by the Probation Office, both the U.S. government and Reksid submitted to the Probation Office objections to the initial presentence report.
Hanson said he also submitted to the Probation Office comments on the U.S. government’s objections to the presentence report.
Hanson said the objections from both the U.S. government and Reksid create a substantial disparity in the proposed final offense level being advocated by the parties and suggested in the initial presentence report.
Reksid was originally scheduled to be sentenced on Jan. 25, 2012, after being convicted in September 2011 of bribery after being found guilty of accepting a $3,000 bribe from the owner of a private company that obtained a federally funded contract from the Department of Public Lands.
