Probationer found using ‘ice’ several times

Justin A. Funkugub, an ex-convict who was required to speak to school children about the dangers of drug use as part of his probation, tested positive for use of methamphetamine or “ice” several times and failed to report for drug testing and counseling session.

U.S. Probation Officer Gregory F. Arriola notified the U.S. District Court for the NMI on Thursday that Funkugub violated the conditions of his supervision by using “ice” on Dec. 3, 27, and 31, 2014.

Arriola said that Funkugub tested presumptive positive for “ice” use during drug testing and he admitted in writing that he used the drug.

Arriola said Funkugub also failed to report for a drug testing on Dec. 28 and 30, 2014, and failed to appear for a counseling session on Jan. 13, 2015.

Arriola recommended that Funkugub’s supervised probation be revoked.

Last December, Arriola also disclosed to the court that Funkugub tested presumptive positive for “ice” use during a random drug test. Funkugub signed an admission form indicating that he used “ice” on Oct. 20, 2014.

At that time, Arriola admonished Funkugub for his behavior and warned him about the possibility that his probation being revoked if his drug use continues.

Arriola then stated that Funkugub will be closely monitored and any additional non-compliance will be reported to the court.

In November 2012, U.S. District Court for the NMI Chief Judge Ramona V. Manglona sentenced Funkugub to 24 months in prison for pleading guilty to the offense of felon in possession of a firearm. The defendant was given credit for 40 days of time served. After serving the prison term, he was placed on supervised release for three years.

Funkugub was found in possession of a Smith & Wesson Model 12-3, .38 caliber snub-nosed revolver whose serial number had been erased.
