Poker operator settles security guard’s discrimination lawsuit

A poker operator has entered into a confidential settlement agreement with a security guard who filed a discrimination lawsuit over his alleged termination from his job because of a complaint he made to the U.S. Department of Labor for illegal deductions on his wages.

Attorney Colin M. Thompson, counsel for guard Edward Iriarte, and attorney Stephen N. Nutting, counsel for D.K.K. Inc. and its principals, Hong Kyun Kim and Kyoun Min Oh, have requested the federal court to dismiss the lawsuit with prejudice, which means the matter cannot be re-opened.

Thompson and Nutting said the parties reached a confidential settlement agreement, including “all claims and defenses that have been brought or could have been brought, with each party to bear their own attorney’s fees and costs.”

U.S. District Court for the NMI Chief Judge Ramona V. Manglona approved the dismissal of the case but retained jurisdiction to enforce the settlement agreement.

Iriarte sued D.K.K. Inc., owner of Dollar Poker II, and Kim and Oh, for retaliation and discrimination based on race and national origin.

Iriarte asked the court to order the defendants to pay him an unspecified amount of back pay with prejudgment interest, front pay, compensation, damages, attorney’s fees, and court costs.

Iriarte went to the U.S. Labor Department on May 28, 2013, to notify it that the defendants were making illegal deductions on employees’ wages, in violation of the Fair Labor Standards Act.

Iriarte said he was terminated from his job on June 13, 2013. The defendants denied the allegations.
