OAG plans to change charges vs Mrs. Pai

The Office of the Attorney General is planning to change the charges it filed against Joanna C. Pai.

At yesterday’s status conference, assistant attorney general Shelli Neal told the Superior Court about the government’s intent to file an amended information.

Associate judge Perry B. Inos set for Dec. 20, 2011, the hearing on Mrs. Pai’s motion to dismiss the case and motion for discovery.

Inos gave the government until Monday to file the amended information.

Mrs. Pai appeared with counsel, former attorney general Rexford Kosack.

In their motion to dismiss, Kosack stated that the only reason Mrs. Pai has been charged is that she is married to Public Auditor Michael Pai, who has attracted the ire of Attorney General Edward T. Buckingham.

Mrs. Pai earlier pleaded not guilty to a count of theft of utility services. She is being accused of allegedly stealing utility services amounting to over $51,000.

In the motion to dismiss, Kosack noted that Mrs. Pai is not a customer as the utility account is in the name of another person.
