Man’s supervised release revoked for violating probation
The federal court has revoked the supervised release of Francisco N. Basa for violating the terms of his probation and sentenced him to four months in prison, with credit for time served.
U.S. District Court for the NMI Chief Judge Ramona V. Manglona ordered Basa to serve the remaining balance under home detention and upon release from imprisonment.
Basa will be placed on 53 months of supervised release.
Basa, through court-appointed counsel, admitted to violating the conditions of his release.
Assistant U.S. attorney Garth Backe recommended an imprisonment term of time served. Defense counsel Benjamin Petersburg recommended the same.
Manglona issued a bench warrant for Basa’s arrest after he failed to appear at a revocation hearing last June 12.
U.S. Probation Officer Gregory F. Arriola told the court that at a March non-compliance meeting for missing a family counseling session, Basa was informed that he should submit to a random drug test. Arriola said before the drug test was conducted, Basa admitted that he used methamphetamine or “ice” a day before due to “personal issues.”
Arriola said that during another non-compliance meeting on April 14, 2015, due to failure to report to a group counseling session, Basa admitted using “ice” a day before because of stress.
That night, Basa again failed to attend a group counseling session.
Basa failed to attend a random drug test on April 27, 2015, and on May 2, 2015.
Arriola said during the non-compliance meeting on May 4, 2015, Basa tested positive for “ice” use and he later admitted to using “ice” that morning because he was stressed out.
In April 2012, federal agents arrested Basa for violating several probation conditions. His supervised release was revoked in August 2012 due to continued use of “ice” and other violations.
In 2006, the federal court sentenced Basa to four years and six months in prison for conspiracy to distribute 50 grams of “ice.” He was placed on five years of probation after completing the prison term. In May 2010, he was arrested for choking and punching his common-law wife.
