Man who hits boy with ext. cord gets 60-day jail term

Superior Court associate judge David A. Wiseman has imposed a 60-day prison term on a man who repeatedly hit a 16-year-old boy with an extension cord on the arm and back and slapped him in the face on Tinian.
Wiseman sentenced 37-year-old Eugene M. San Nicolas to a year in prison, all suspended except for 60 days, for assault and battery.
In a written order issued early this week, Wiseman gave San Nicolas credit for the seven days he had already spent in jail.
San Nicolas was ordered to start serving the remaining days of his sentence on Jan. 10, 2012. He will be released on April 3, 2012.
After completing his sentence, San Nicolas will be placed on supervised probation for a year. He was also directed to undergo anger management counseling and to pay a $100 fine, $25 court assessment fee, plus probation fee.
The Office of the Attorney General had charged San Nicolas with assault with a dangerous weapon, child abuse, assault and battery, and disturbing the peace.
San Nicolas, assisted by assistant public defender Benjamin Petersburg, pleaded guilty to assault and battery as part of a plea deal. The remaining charges were dropped.
San Nicolas hit the victim in the face several times and repeatedly struck him with an extension cord on Feb. 18, 2011. A responding police officer observed swelling on the boy’s back, left arm, behind the left ear, left forearm, and right hand.
Police said that San Nicolas admitted hitting the boy for talking back.
Assistant attorney general Russell Lorfing prosecuted the case.
