Man who choked girlfriend gets 5-day sentence

A man who, while intoxicated, choked his girlfriend in front of their young daughter, was slapped with a five-day prison term.
Abelardo Miranda Magno, 34, pleaded guilty on Thursday to assault and battery and disturbing the peace as part of a plea bargain.
Superior Court Associate Judge Kenneth L. Govendo sentenced Magno to a year and six months in prison, all suspended except for five days, with credit for the two days he has already served in jail. He was ordered to start serving the remaining three days of his sentence on Friday, June 29, at 9am.
After completing his sentence, Magno will be placed on supervised probation for two years. He was required to pay a $250 fine, $25 court assessment fee, plus probation fee.
Magno was also ordered to write a letter of apology to the victim and to complete anger management counseling and a parenting class, alcohol and drug counseling/treatment.
According to the plea agreement, on Dec. 3, 2011, on Saipan, Magno hit his girlfriend in the back twice and choked her in front of their 5-year-old daughter.
Police detective Catherine B. Pangelinan stated in her report that Magno had been drinking beer since 12pm that day. At 5pm, he gave his girlfriend some money to buy him food. As the girlfriend was looking for a phone book to call a restaurant, Magno got upset and took back the money.
Magno then pushed his girlfriend and choked her. She managed to get away and run to neighbors to call for police’s help.
