Man gets 90 days in jail for resisting arrest on Rota

Defendant also kicks police car; has pending domestic violence

Superior Court Associate Judge Joseph N. Camacho has slapped a 90-day prison term against a 20-year-old man on Rota who resisted police arrest and damaged a police car by kicking it.

Camacho on Friday sentenced Raymond D. Castro Jr. to the maximum of one-year imprisonment, all suspended except 90 days, for resisting arrest.

Castro was given credit of five days of time served.

Camacho said the remainder of the one-year imprisonment may be imposed for any violation of law or rules.

Castro, through counsel assistant public defender Tillman Clark, requested if he could turn himself to the Department of Corrections at a later time.

Camacho denied the request, saying DOC is not a hotel, where he can choose when to check in.

The court marshals were ordered to transport Castro to DOC to start his sentence immediately.

After serving the prison term, Castro will be placed on supervised probation for two years. He was ordered to pay a $100 fine, $25 in court costs, and $200 in probation fee.

The defendant was ordered to pay $4,147.18 at a rate of $50 per month in restitution to Rota Department of Public Safety over the damaged police car.

During the probationary period, Castro is prohibited from consuming any alcoholic beverages. He was required to perform 200 hours of community work service.

According to the factual basis of the plea agreement, Castro resisted and obstructed being arrested by Police Officer Shaw Dela Cruz Taisacan by being uncooperative and fighting back on Rota on Sept. 13, 2015. The two struggled on the ground and the officer could not place handcuffs on Castro. The officer did not require any medical care.

According to court documents, Castro damaged the police car by kicking its rear driver side door frame, the front fender, and the center console compartment.

Castro also allegedly elbowed Taisacan in the chest and choked the officer.

The officer was trying to arrest Castro for allegedly driving a car recklessly and for consuming beer while under 21 years old.

Castro has a pending domestic violence case against his own father.
