Man gets 23 days in jail for threatening to kill brother

A man who was arrested reportedly for threatening to kill his brother and family with a rifle during their argument over a land dispute, pleaded guilty yesterday to the offense of disturbing the peace.

Superior Court associate judge David Wiseman accepted defendant Ramon Sablan Tudela’s guilty plea and sentenced him to 30 days in prison, all suspended except 23 days.

Wiseman gave the 47-year-old Tudela credit for the 23 days he already served in jail.

It means that the defendant was released yesterday from the Department of Corrections and will no longer serve more jail term.

During a one-year probationary period, Tudela will be required to abstain from consuming any alcoholic beverages and shall have no direct or indirect contact with his brother and his (brother) immediate family.

Wiseman ordered Tudela to pay a $50 fine and a $10 court assessment fee.

According to the plea agreement, on Nov. 24, 2011 on Saipan, Tudela deprived his brother of his right to peace and quiet by threatening him and his family.

A police detective testified that during the argument, a rifle was found in Tudela’s vehicle.

Apparently there was grabbing back and forth of the rifle between the brothers.
