Man gets 12-day sentence for beating up girlfriend

Shadel Remeliik Daniel, a 28-year-old band singer accused of beating up his girlfriend, pleaded guilty to disturbing the peace yesterday in Superior Court and was slapped with a 12-day prison term.

Daniel pleaded guilty to disturbing the peace as part of a plea deal.

Associate Judge Teresa Kim-Tenorio sentenced Daniel to six months in prison, all suspended except for 12 days, with credit for three days of time served.

This means Daniel shall serve nine more days in prison, starting on June 17, 2014. He is expected to be released on June 25.

After completing the prison term, Daniel will be placed on probation for one year.

Daniel was required to pay a $100 fine, plus court and probation costs, perform 100 hours of community service, and complete anger management counseling.

He is prohibited from consuming alcoholic beverages and from going into bars during his probation. Daniel, however, is allowed to go to the True North Bar for work.

As part of the plea deal, the remaining charge of assault and battery was dropped.

Chief public defender Douglas Hartig appeared as counsel for Daniel. Assistant attorney general Barbara Cepeda prosecuted the case.

According to police, Daniel and his girlfriend had been drinking at True North Bar on Jan. 11, 2014, on Beach Road when they proceeded with other people to the pavilion across the street and continued their drinking session.

Daniel later confronted his girlfriend why she was talking to his co-worker. He then allegedly held her mouth and squeezed it hard, causing her to fall to the ground.

Daniel allegedly sat on top of her and continued holding her mouth, prompting her to scream. Her two female friends came and drove her to a store in San Jose, where they called police.

The victim sustained bruises on the face and arm. She also complained of back pain.

She told police that Daniel is getting worse as he has been beating her up out of jealousy.
