Man acquitted of beating wife, child

Superior Court Associate Judge Joseph N. Camacho on Friday acquitted of all charges a man accused of beating up his common-law wife and one of their four children at their house in San Antonio.
After a two-day bench trial that ended on Friday, Camacho ruled that the prosecution failed to prove its case against 28-year-old Helimar Ayala Santiago.

The judge found that the common-law wife was the initial aggressor.

Santiago had been charged with two counts of assault and battery, one count of child abuse, and two counts of disturbing the peace.

Attorney Samuel Mook served as court-appointed counsel for Santiago. Assistant attorney general James McAllister prosecuted the case.

Police said as a result of the incident that occurred on Aug. 28, 2013, a 7-year-old boy sustained contusions on cheeks, while his mother had contusions on the head, hip, and right wrist. Both were treated at the Commonwealth Health Center.

Police detective Jesse K. Seman stated in his report that police responded to a residence in San Antonio on Aug. 28, 2013 at 2:15pm after a man reported a disturbance. Police officer Norris Kwon learned that Santiago allegedly beat up the common-law wife, slapped their son, and left on a vehicle.

Police said Santiago denied beating up his wife, but admitted hitting the boy. He was then arrested.
