‘Lawsuit vs Xtra Airways will proceed’
It had previously been reported that the $50-million lawsuit filed against Xtra Airways will not be pursued by the plaintiffs. This is not correct nor accurate.
The previously filed lawsuit has been dismissed temporarily for procedural reasons and the plaintiffs intend to refile as soon as possible. There is new serious evidence available against Xtra that was not included in the original complaint.
When the complaint and suit have been amended, the case will be refiled in the courts of Saipan. New counsel will direct the lawsuit on behalf of all the plaintiffs in China and Saipan to seek redress from Xtra for the unsafe charter operations and premature cancellation of flights between Saipan and cities in the Chinese mainland.
Dream Pacific Aviation Services (HK) Ltd as well as Impression Tours and the owners of both the Saipan Restaurant and those of the New Shin Restaurant, along with BW Car Rental and 21 Chinese tourists filed a racketeering and fraudulent conduct lawsuit against Xtra Airways Inc. of Florida and its owners and management.
