Lawsuit vs XTRA Airways, its execs is dismissed
The federal court dismissed Friday a lawsuit filed against the owner of the Florida-based XTRA Airways Inc. and its officials by a former company manager.
U.S. District Court for the NMI Chief Judge Ramona V. Manglona dismissed with prejudice the lawsuit filed by Thomas L. Nolte against TEM Enterprises and its officials after the parties reached a settlement agreement. Dismissed with prejudice means Nolte can no longer re-file the case.
Nolte sued after he was allegedly terminated without cause a few months after being hired in 2017.
Nolte, the airline’s former manager for its Asian operation, and TEM Enterprises, through their respective counsels, Colin M. Thompson and Robert Turk, agreed to the voluntary dismissal of the case.
The parties recently informed the court that they have finalized the terms of an agreement that settles the case.
Manglona reviewed the settlement, directed the clerk of court to close the case, and ordered the parties to bear their own costs.
In the original complaint, Nolte sued XTRA Airways, saying that the company’s true goal in hiring him was to boost XTRA’s value. The defendants denied the allegations.
