Lawsuit against CNMI govt dismissed
The lawsuit filed against the CNMI by a man who was injured in an accident involving a government vehicle back in 2015 was dismissed without prejudice last Wednesday.
Superior Court Associate Judge Joseph Camacho granted the Commonwealth’s motion to dismiss the case without prejudice based on deficiencies found in Palacios’ notice of claims.
Palacios sued the CNMI after a government vehicle that was being driven by John Duenas San Nicolas allegedly caused Palacios several injuries.
However, Palacios failed to provide a sum for monetary damages to accompany the notice of claims that he filed with the Office of the Attorney General.
Dismissed without prejudice means Palacios is allowed to re-file the case, to make it compliant with the Government Liability Act.
The Government Liability Act governs claims against the Commonwealth government.
Palacios has since been granted 60 days to resubmit his claim to the Attorney General’s Office.
Palacios filed the lawsuit against John Duenas San Nicolas in 2015 over a vehicular accident that happened along Chalan Pale Arnold Road on May 27, 2014.
According to the lawsuit, Palacios was traveling south on the inner lane of Chalan Pale Arnold and was turning left to the Commonwealth Health Center.
San Nicolas, who was driving a government vehicle, was allegedly travelling very fast and hit Palacios’ vehicle.
Palacios sued San Nicolas for reckless, careless, and negligent driving.
