Jurors deliberate in burglary case vs Cabael
A Superior Court jury began deliberating yesterday in the case against Kyle Cabael, a man accused of being part of a group that burglarized one of the rooms at Monte Vista Hotel and Restaurant in Navy Hill.
The six jurors started deliberations at 5pm. After an hour, Associate Judge Joseph N. Camacho sent them home and directed them to return at 8:15am today to resume deliberation.
The trial began Monday.
Assistant attorneys general James McAllister and Clayton Graef called a total of nine witnesses. Cabael’s lawyer, Colin Thompson, called one witness.
After the government rested, Thompson moved for acquittal. Camacho denied the motion and instructed the jury to decide on all three counts: burglary, theft, and conspiracy.
Police said that cash and several items were stolen from one of the rooms at Monte Vista Hotel and Restaurant during the Feb. 17, 2014, burglary. A surveillance camera at a nearby store led to the arrest and filing of charges against Cabael and two co-defendants.
Cabael’s co-defendant pleaded guilty. The government dropped the case against a third defendant.
