Judge transfers company’s lawsuit against two firms to Guam

U.S. District Court for the NMI visiting judge William Q. Hayes has ordered the transfer of a company’s lawsuit against two affiliated Guam corporations to Guam in the interest of justice.

Hayes ordered the U.S. District Court for the NMI’s clerk of the court to transfer the lawsuit filed by Allied Marine Surveyors Limited to the District of Guam.

Allied Marine Surveyors Limited is suing International Corp. and Inter Bay Circle Marine Inc. for allegedly failing to pay $351,940.34 for marine-related services. The plaintiff asked the court to find the two companies liable to pay damages with interest and cost.

Allied Marine is engaged in marine surveying, marine risk management, underwater inspections, repairs, salvage operations, and related business activities. The company has provided marine related services to the defendants for about 20 years.

The lawsuit alleged that Inter Bay was the operator of a tugboat and three barges. International Bridge, a general construction company, allegedly made some payments to plaintiff for services provided to the vessels.

The defendants had asked for the transfer of the case to Guam, as that is where they reside and where Allied Marine alleges it performed some of the services at issue.

In his ruling, Hayes said it would be “time-consuming and justice-defeating” to require Allied Marine to re-file its case in the District of Guam.
