Judge finds 10-year jail term too lenient for repeat child molester

Finding a 10-year imprisonment too lenient to impose on a repeat child molester, Superior Court Associate Judge Joseph N. Camacho has rejected a proposed plea agreement with the defendant.

At a change of plea hearing on Friday, Camacho noted that defendant Nathan I. Narcis, 31, has two prior convictions in which another judge slapped him with barely 18 months prison term.

In this pending case, Camacho said, there is a third victim.

The government charged Narcis, also known as Nate Dawg, with sexual abuse of a minor in the second degree and disturbing the peace for sexually abusing a 7-year-old girl on Rota last May 21.

Assistant attorney general Betsy Weintraub told the court that the government is aware of the prior convictions, but decided to offer a plea bargain anyway.

Weintraub stated that Narcis will be a registered sex offender if the court accepted the government’s proposed plea agreement.

Weintraub agreed with Camacho that Narcis was already a registered sex offender.

Camacho further inquired if Narcis being a registered sex offender prevented him from his third victim, to which Weintraub replied “no.”

The proposed plea bargain recommended a 15-year imprisonment all suspended except 10 years, with credit of time served, plus other conditions.

With the rejection of the proposed plea bargain, Narcis then chose to do an open guilty plea.

It means that the defendant pleaded guilty to the sexual abuse of a minor in the second degree but not by a plea agreement.

Sexual abuse of a minor in the second degree refers to sexual contact but no penetration.

By entering an open guilty plea it means that Narcis throws himself at the mercy of Camacho, who set the sentencing for Dec. 14, 2016 at 9am.

Camacho ordered the Office of Adult Probation to prepare a pre-sentence investigation report.

Assistant public defender Tillman Clark is counsel for Narcis.

After the hearing, Narcis was remanded into the custody of the Department of Corrections.

Rota Police Detective Tito S. Hocog II stated in his report that police arrested Narcis last May 21 after the girl’s mother contacted Rota Department of Public Safety to file a complaint of child molestation against Narcis.

Hocog said the mother learned about the incident that night after her daughter went to her, looking scared and with a shivering voice.

The girl told her mother that Lizama touched her private part.

Hocog said Narcis is a registered sex offender after he was convicted with sexual abuse of a minor in the second degree in 2008.

Hocog said as a registered sex offender, Narcis is prohibited to be anywhere with minors.

At the time he was arrested, Narcis was employed as a community worker at the Rota Municipal Council.
