Judge OKs evaluation of defendant’s competency

A 20-year-old man named Hitler Sem Weilbacher who allegedly stole a Toyota 4-Runner and a Toyota Highlander, has mental illness and Chief Public Defender Douglas W. Hartig has asked the court to appoint a psychiatrist to check if Weilbacher is competent to stand trial.

Hartig, representing Weilbacher, has asked the Superior Court to stay the proceedings and to appoint the California-based psychiatrist, Dr. Martin Blinder, or another forensic psychologist to perform a competency evaluation on Weilbacher.

Associate Judge Joseph N. Camacho granted Hartig’s request yesterday, with the fee not to exceed $1,500.

Hartig said that at the Nov. 17, 2017, hearing, Weilbacher appeared to have difficulty understanding the proceedings and was having difficulty communicating with him and associate judge Wesley Bogdan.

Hartig said he is of the opinion that Weilbacher cannot meaningfully assist in his own defense.

He disclosed that Weilbacher was diagnosed with mental illness earlier this year, that Blinder found Weilbacher last Feb. 4 to be incompetent to stand trial in a previous criminal case.

Police arrested Weilbacher last Nov. 16 shortly after he allegedly stole a Toyota 4-Runner from a parking lot of a store on Capital Hill.

Police also arrested him last June 21 at Hopwood Middle School in Chalan Piao, where a stolen Toyota Highlander was recovered and later returned to the owner.
