Firm sued for alleged refusal to pay rent for power genset

A company has sued another for allegedly refusing to pay rent for a 500-kilowatt generator installed as back-up power at the Aqua Resort Hotel.

Seafix Inc., through counsel Stephen J. Nutting, is suing The Power Source Group LLC for breach of contract and wants it to pay $33,000 in damages plus interest, attorney’s fees and court costs.

According to the complaint, Seafix and Power Source entered into an agreement in which Seafix would provide a 500-kw generator to Power Source to serve as a back-up generator at the Aqua Resort Hotel for a daily rate of $350 per day.

In addition, Nutting said, Power Source was to pay $150 for the transportation of the generator and an additional $1,050 to hook up the generator.

“Thereafter, and despite repeated demands made by Seafix and its attorney to collect the sums due and owing for the generator rental, Power Source refused, and continues to refuse to make any payments due under the contract,” the lawyer said.
