Domestic violence lands man in prison for 30 days
Superior Court Associate Judge Perry B. Inos last week sentenced Lucian Ignacio George to six months in prison, all suspended except for 30 days.
The 44-year-old George was given credit for the nine days he has already served in jail. He will begin serving his sentence on July 9, 2012.
Once he gets out, George will be placed on one year of supervised probation. He was also ordered to pay a $100 fine plus probation fee.
In a bench trial in May, Inos acquitted George on the charges of assault and battery and interfering with a domestic violence report but found him guilty of disturbing the peace.
Assistant attorney general James McAllister recommended a sentence of 90 days in jail.
McAllister said the government provided evidence at trial that George repeatedly called the victim’s phone until she finally agreed to have dinner with him one last time.
George showed up for dinner drunk and threatened to kill the victim’s family, friends, and co-workers, and “cover the table with blood.” He then snatched the victim’s phone as she was calling for help.
“These events severely frightened [the victim] and she was visibly shaken when testifying in court,” he said.
McAllister said the evidence also showed that George grabbed the victim’s face and squeezed her neck.
The prosecutor noted that George is facing another domestic violence charge against the same victim.
In that case, McAllister said, the government will show that over the course of more than a year, the defendant engaged in several incidents that frightened the victim, including reckless driving, harassing phone calls, and even stabbing a bed where she was seated.
Assistant public defender Benjamin K. Petersburg recommended a sentence of nine days, with credit for nine days already served.
Petersburg also recommended that his client, George, be placed on one year of probation and that he stay away from the victim, complete anger management counseling, attend alcohol and drug counseling.
