The father of a female Chinese tourist who drowned in the waters off Mañagaha in 2012 has retained a Saipan lawyer to file a wrongful death lawsuit.
Wang Xiao Ting, 65, hired William M. Fitzgerald to prosecute his lawsuit against any person found to be responsible for the death of his daughter, Wang Dao.

Fitzgerald filed on Friday in the U.S. District Court for the NMI a petition, asking the court to appoint Wang Xiao Ting as personal representative of Wang Dao.

Fitzgerald said that Wang Dao, 33, passed away on April 16, 2012, on Mañagaha.

Wang Dao’s next of kin are her father, Wang Xiao Ting, and her mother, Shen Li Hua, both residing in China.

Fitzgerald said the father is the proper and appropriate person to bring a civil action arising out of his daughter’s death.

Fitzgerald did not disclose who they are planning to sue.

According to a police report, Wang Dao and her group went to Mañagaha on April 16, 2012. Witnesses told police that Dao was seen lying down in the water as the group members were exiting the water to head back to shore.

Witnesses called for help as they applied CPR on Dao. A boat then brought the victim to Smiling Cove Marina. Two lifeguards administered CPR on the victim on their way to the dock.

Medics brought the victim to the Commonwealth Health Center, where a doctor pronounced her dead at 2:56pm that day, police said.
