Customer sues restaurant for alleged fall

A woman has sued an establishment in Garapan for the alleged injuries she sustained when a protruding metal rebar in the parking lot caused her to trip and fall to the ground.

Veronica Cruz Velasco, through counsel Victorino DLG. Torres, is suing Himawari Saipan Inc. for negligence. She is demanding unspecified damages, attorney’s fees, and court costs.

Himawari operates a store, bakery, and restaurant.

Saipan Tribune contacted Himawari yesterday for comment, but one of its owners, Tatsuhito Suzuki, was not available as of press time.

Torres stated in the complaint that Velasco was walking toward Himawari from the parking lot, on March 14, 2011, when she tripped over a bended rebar that was protruding but was not adequately visible. Torres said that Velasco fell to the ground and sustained unspecified injuries.

The lawyer said that Himawari failed to provide any sign whatsoever that there was a bended rebar in the way and intruding upon the customers’ pathway. Himawari failed to put a cone or barricade to give any warning, Torres said.
