CUC enters settlement with former staff

The Commonwealth Utilities Corp. has entered a confidential agreement with a former employee, Carlton Stevens, who filed a discrimination lawsuit against the agency.

U.S. District Court for the NMI designated Judge Frances M. Tydingco-Gatewood dismissed with prejudice Stevens’ lawsuit yesterday.

The dismissal follows the parties’ stipulated request.

Dismissal with prejudice means Stevens can no longer re-file the case.

The judge said pursuant to the parties’ request, the court retains jurisdiction to enforce the terms of the agreement.

Attorney James Sirok is counsel for CUC. Attorney Pamela Brown-Blackburn is counsel for Stevens.

Stevens, an African-American, sued CUC and its four officials for allegedly not renewing his contract as direct responsible charge operator in CUC’s wastewater division, providing him a used and inoperable computer, and not providing him an office space, among other complaints.

In December 2014, the court dismissed the lawsuit. Steven then filed an amended complaint that named only CUC as defendant.
