CHC deemed under the Federal Tort Claims Act

The Kagman Community Health Center received its Notice of Deeming Action that it is covered under the Federal Tort Claims Act.

A deemed health center, its board, and employees are considered federal employees and are immune from lawsuits for medical malpractice, with the federal government action as their primary insurer.

Among other requirements, KCHC had to demonstrate that it has implemented appropriate policies and procedures to reduce risk of malpractice litigation and conducts review and verification of professional credentials and privileges, references, claims history, fitness, professional review organization findings, and licensure status of its health professionals in order to deemed.

KCHC was been unable to get private medical malpractice coverage due to unavailability in the CNMI, “so this is a tremendous accomplishment,” according to a statement from the KCHC.

To make an appointment or to get information, call 256-KCHC (5242). Walk-ins are welcome depending on availability. Patients with appointments are given priority to be seen.

KCHC is a federally qualified health center that serves all patients regardless of inability to pay. Everyone is welcome, even those that reside outside the Kagman area. (PR)
