Career criminal gets 6 months in jail for breaking appliances at home

Career criminal Nestor Camacho Taitano was slapped with a six-month prison term for breaking several appliances at their house in Dandan, prompting her mother to call police for fear.

Superior Court Associate Judge David A. Wiseman last week sentenced the 41-year-old Taitano to a total of one-year imprisonment for criminal mischief and six months imprisonment, all suspended except six months.

Taitano was given credit for four months and two days of time already served. It means that he shall be released from jail on March 16, 2016.

Wiseman noted that Taitano has a significant criminal history and that he previously rejected a plea agreement, which he found to be too lenient.

Wiseman said the sentence here is twice of the previous proposed plea deal.

In issuing this sentence, Wiseman noted that Taitano expressed sincere remorse, has acknowledged his drug problems and is willing to seek help.

The judge said the incident is a misdemeanor and no one was injured or assaulted.

After completing the prison term, the defendant will be placed on supervised probation for one year. He was required to complete counseling or treatment at the Community Guidance Center.

Taitano is prohibited from going to his mother’s house and work during the probationary period. He is not allowed to consume alcoholic beverages.

Taitano was ordered to pay a $100 fine, $25 court costs, plus probation fees.

Assistant public defender Tillman Clark, counsel for Taitano, recommended the same sentence that Wiseman imposed. Assistant attorney general Shannon Foley appeared for the government.

Clark said Taitano pleaded guilty because he loves his mother, he regrets what he did to scare her and damage her property.

Clark said the evidence against Taitano suggests that he damaged and generally tore apart his mother’s residence.

“This is criminal behavior and deserves punishment. However, no one was hurt,” said Clark, adding that the house was not burglarized and the items damaged were small and low in value.

He said the damage done was the result of an angry outburst.

Clark said it is also clear that Taitano is the victim of some drug dependency and mental health issues.

Taitano pleaded guilty to criminal mischief and disturbing the peace.

According to the factual basis of the plea agreement, on Sept. 14, 2015, Taitano broke various appliances, household items and damaged a window screen belonging to his mother.

This caused the mother to leave her house and call the police because she was afraid.

The mother told police that his son turns violent whenever under the influence of illegal drugs.

Taitano would scream at night or come home early morning and talk to himself. She is scared to stay at her house believing that he might hurt her or even kill her.
