Man facing child sexual abuse charge denied TPC

Superior Court Associate Judge Joseph N. Camacho has denied a motion to release to a third-party custodian a man accused of sexually abusing a minor in front of his girlfriend inside a motel room in San Jose.

Camacho on Thursday denied Parvej Mohamed Barpery’s motion to be released to a third-party custodian as the court finds the location of the house on Rota not suitable.

Camacho found that the house of Barpery’s uncle, the proposed third-party custodian, is near another residence that has children in it.

Barpery, 44, cried after the court denied his motion. Attorney Daniel Guidotti is counsel for the defendant.

Guidotti asked the court to reduce the $100,000 cash bail to $50,250 to reflect the greatly reduced amended information. He asked the court to permit Barpery’s release to a third-party custodian upon posting $2,000 cash.

The Office of the Attorney General recently filed an amended information, charging Barpery with one count of sexual assault in the first degree and one count of disturbing the peace.

The OAG charged Barpery’s girlfriend, Daisina Suda, 41, only with one count of disturbing the peace.

Assistant attorney general James McAllister has filed a motion to allow the government to file a second amended information adding a charge of sexual assault in the first degree against Suda.

Suda allegedly allowed Barpery to sexually abuse the 17-year-old girl in front of her inside a motel room in San Jose last year.

Police arrested the two last month.

Police detective Isapen Bokuku stated in her report that police started investigating the incident on Nov. 26 when the Department of Public Safety received a call about a sexual abuse of a minor that occurred in San Jose, Saipan.

Bokuku said that during her interview with the alleged victim on Jan. 8, she said that Barpery sexually abused her in May 2013 when she was just 17 at the San Jose Motel.

Police arrested Suda last New Year’s Day for allegedly biting Barpery below the right nipple and chasing him with a knife at their residence in Lower Miha, Garapan. She was temporarily released in that case.

Last September, Suda and Barpery were both arrested after they engaged in a brawl at their house in Garapan. The two pleaded guilty and served prison terms.
