Judge to hear Crisostomo’s bid to suppress footprint evidence

Superior Court Associate Judge Joseph N. Camacho will hear attorney Janet H. King’s objection to the Office of the Attorney General’s execution of a search warrant in which footprints were taken from her client, Joseph A. Crisostomo, without her presence.
Camacho said he will hear the arguments on Crisostomo’s motion on Jan. 24, 2014, at 1:30pm.
The OAG was allowed to file any opposition to Crisostomo’s motion on or before Jan. 17. Crisostomo was allowed to reply on or before Jan. 22.
The other motion to be heard that same day is the OAG’s motion for deposition or online video conferencing testimony.
Arguing that such taking of footprints was a violation of Crisostomo’s Sixth Amendment rights, King asked the court to suppress the footprint evidence.
Crisostomo faces charges of kidnapping and killing bartender Emerita Romero in February 2012.
King said the government seized six barefoot prints of her client at the Department of Corrections on Dec. 24, 2013, using a search warrant issued by Superior Court Associate Judge Kenneth L. Govendo.
King said she was not aware of the OAG’s application for the search warrant, until between 9am and 9:15am on Dec. 24, at the time the search warrant was being executed.
