Lifeguard arrested for alleged sex abuse of a minor

A lifeguard was arrested on Sunday night for allegedly kissing and touching a minor and punching a cash register of a store in Kagman I.
Frankie C. Demapan, 23, was arrested for sexual abuse of a minor in the third degree, criminal mischief, assault and battery, and disturbing the peace.
At a hearing yesterday, Superior Court Associate Judge Teresa Kim-Tenorio kept the $10,000 cash bail the court initially imposed for Demapan’s temporary release. If he asks to modify the bail, Kim-Tenorio said she would insist on a third party custodian for him.
Assistant attorney general Peter Prestley had recommended a $10,000 cash bail, while assistant public defender Michael Sato, counsel for Demapan, asked for the amount to be reduced, saying that majority of the charges are misdemeanor offenses. The judge denied Sato’s motion.
Kim-Tenorio said she is bothered that a 13-year-old girl is involved as the alleged victim.
“I consider that quite serious,” the judge said, referring to the charge of sexual assault of a minor in the third degree.
Preliminary hearing will be on Jan. 16 at 9am.
Kim-Tenorio also noted that Demapan has two outstanding bench warrants for traffic cases issued in December 2012 and in October 2013.
Sato explained that the bench warrant for 2012 is a clerical error as Demapan already pleaded guilty in that case. He also moved to quash the 2013 bench warrant.
Kim-Tenorio quashed the bench warrants and set a status conference for the two cases on Jan. 27 at 1:30pm.
Police detective Jesse K. Seman stated in his report that a police officer was dispatched on Sunday at 10:52pm to a store in Kagman I where a disturbance call was reported.
The alleged victim told police that Demapan, who is her sister’s boyfriend, kissed her and touched her leg and thighs. When she resisted, he allegedly held her hands and pulled her down on the bed and kissed her on the neck. That’s when the sister walked in and saw what was happening. The sister told their mother about it. The mother confronted Demapan and told him to get out.
Demapan became angry and allegedly punched a cash register twice, damaging it. The mother then called the police.
