Probable cause is found to charge waiter in rape case

Superior Court Associate Judge Teresa K. Kim-Tenorio has found probable cause to charge a waiter who is accused of raping a woman four times, including at knifepoint, and of threatening to kill the victim and her husband.
In her first preliminary hearing on Tuesday, the newly-sworn judge found probable cause to charge 42-year-old Abu Yousuf with four counts of sexual assault in the first degree, two counts of assault with a dangerous weapon, one count of stalking in the second degree, one count of assault and battery, five counts of burglary, one count of theft, and three counts of disturbing the peace.
Kim-Tenorio, however, found no probable cause for one count of sexual assault in the second degree. She dismissed the charge.
Yousuf will be arraigned on Jan. 13 at 9am.
Assistant public defender Benjamin Petersburg served as counsel for Yousuf.
According to the charges, Yousuf raped the victim on Tinian in October and November 2013. He also allegedly broke into the victim’s house in December and scratched her face and neck during their struggle.
On Dec. 17, 2013, Yousuf also allegedly broke into the victim’s house where he stole her dress. He threatened the victim that he would tell her husband that they’re having an affair.
