The federal court has denied the request of former CNMI adult probation officer Robin N. Sablan to be released from jail pending his sentencing on drug charges.

At a hearing Friday, U.S. District Court for the NMI Chief Judge Ramona V. Manglona said that Sablan may not be a flight risk but he still poses a danger to the community because of his past drug use.

Manglona also moved Sablan’s sentencing on Jan. 17, 2014, to March 5, 2014.

Sablan was remanded into the custody of the U.S. Marshal.

Sablan was been detained at the Department of Corrections since federal authorities arrested him on Aug. 22, 2012, for conspiring with others to distribute methamphetamine or “ice.” In October 2012, he pleaded guilty to conspiracy to distribute “ice” as part of a plea deal.

Sablan, through court-appointed counsel Steven Pixley, moved the court for his release to his mother as third party custodian pending his sentencing.

Pixley argued that Sablan is not a flight risk and has no history of committing any violent crime or offense.

Assistant U.S. attorney Ross K. Naughton said the U.S. government has no objection to Sablan’s release pending his sentencing, assuming the conditions for his release are acceptable to the court and the U.S. Probation Office.

At the hearing on Friday, Pixley inquired with U.S. Probation as to their objection based on Sablan’s past drug use.

U.S. Probation Officer Gregory Arriola stated that their objection to the defendant’s release was based on his prior non-compliance with release conditions.
