Man gets 12 year, 6 month term for sex abuse of minor

A 58-year-old man was slapped with a maximum sentence of 12 years and six months in prison, to be served without the possibility of parole, for sexually abusing a 10-year-old girl on Saipan.

Superior Court Associate Judge Joseph N. Camacho ordered Masaii Misasy Samuel to register as a sex offender.

After serving his sentence, Samuel, a Chuukese, will be transferred to the custody of the Department of Homeland Security, Immigration and Customs Enforcement Division for deportation.

Samuel and counsel, assistant public defender Michael Sato, signed a plea deal with the government, represented by assistant attorney general Barbara Cepeda.

Samuel pleaded guilty on Thursday to the offenses of sexual abuse of a minor in the second degree, assault and battery, indecent exposure in the second degree, and disturbing the peace.

According to the plea deal, Samuel, who was 56 years old at the time, sniffed the girl’s privates over her underwear in November 2012. He also exposed his privates to the girl, “all of which unreasonably annoyed, disturbed and deprived [her] of her right to peace and quiet.”

Samuel was sentenced to the maximum 10 years in prison for sexual abuse of a minor in the second degree.

For assault and battery, Samuel was sentenced to the maximum one year in prison.

For indecent exposure in the second degree, he was sentenced to a maximum of one year in prison.

For disturbing the peace, the defendant was sentenced to the maximum six months in prison.

Camacho said the sentences in all four counts shall run consecutively for a grand total of 12 years and six months to be served day for day without the possibility of parole, work release, early release or any other similar programs.

Samuel was given credit for time served.

Police arrested Samuel in February.

Police detective Rudolfo Hermosilla stated in his report that, on Feb. 5, 2013, at 9:48pm, a police officer responded to a call of sexual abuse case at a house in Dandan.

Hermosilla said the girl confessed to her grandmother that Samuel sexually abused her on a Monday morning in November 2012.

The girl resisted by repeatedly punching Samuel’s head. The defendant, however, continued sexually abusing her.

The detective said that during his interview last Feb. 11, Samuel admitted sexually abusing the girl, but denied there was penetration.
