Judge grants Fund request for hearing on its several motions

U.S. District Court for the NMI Bankruptcy Division designated judge Robert J. Faris has granted the NMI Retirement Fund’s request to immediately hold a hearing on its several motions.

On Thursday, Faris set the hearing on the Fund’s motions for June 1, 2012, at 9:30am.

Faris said any opposition to the motions shall be filed on or before May 18 and any reply shall be due on or before May 25.

The judge directed the Fund to provide notice of the hearing to the U.S. Trustee, 20 of its largest unsecured creditors, parties that have requested notice in this case, the Office of the Attorney General, and counsel to the official committee of unsecured creditors.

The motions include:

– An entry of order providing for the continued payment of certain benefits to Fund beneficiaries.

– An entry of order establishing bar dates for filing proofs of claim and approving the form and manner of notice thereof of creditors other than Fund beneficiaries.

-An entry of order authorizing the employment and retention of Boston-based law firm Brown Rudnick as counsel for the Fund in the bankruptcy case.

– An entry of order authorizing the employment and retention of Buck Consultants as an actuarial consultant for the Fund.

– An entry of order authorizing the retention and employment of the law office of Braddock J. Huesman as special counsel and designated local counsel for the Fund in the bankruptcy case.

Faris earlier granted the U.S. Trustee’s request to conduct a hearing on June 1, 2012, at 9:30am on its motion to dismiss the Fund’s Chapter 11 bankruptcy petition.
