Man challenges gym staff to a fight, gets 7-day sentence
A man accused of screaming and challenging a Gold’s Gym staff to a fight and stealing two energy bars worth $2.50 each pleaded guilty and was sentenced to seven days in prison.
David Wayne Clare, 58, pleaded guilty Wednesday to disturbing the peace as part of a plea agreement. He was sentenced to 30 days in prison, all suspended except for seven days, with credit for the seven days he has already served in jail. This means he will no longer serve further jail time.
Clare will be placed on probation for six months and was ordered to pay a $50 fine, $25 court assessment fee, and $60 probation fee.
Superior Court Associate Judge Kenneth L. Govendo also ordered Clare to immediately pay Gold’s Gym $5 for the two energy bars he stole.
Clare is also barred from any contact with Gold’s Gym for the entire six months of his probation.
So long as Clare pays the restitution, fine, court costs, and probation fee, he may leave Saipan and need not return for a review hearing, Govendo said.
Clare reportedly lives in Guam.
The Office of the Attorney General had charged him with theft, assault, and disturbing the peace. The remaining charges were dropped as part of the plea deal.
Clare entered Gold’s Gym on April 24, 2012, and challenged a male staff to a fight by raising his fists and screaming threats at him.
