USCIS reminds employers to respond to each RFE
Employers must send a response with documentation for each Request for Evidence, or RFE, that they receive from U.S. Citizenship and Immigration Services. Employers may not submit one response with documentation for multiple petitions.
USCIS received some RFE responses in which an employer provided the necessary documentation for one file and listed in a cover letter several receipt numbers for other petitions that had received a similar RFE notice. Employers risk having their petitions denied if they do not provide a complete response to each RFE that they receive. The RFE describes the evidence that is needed for each individual petition.
Each I-129CW petition is handled separately, each RFE lists the unique receipt number of the petition for which USCIS needs additional information and each RFE is mailed out separately. The RFE provides instructions for responding. Employers must respond to each individual RFE within the 84-day deadline, as described in the RFE instructions, or the petition may be denied.
A request for evidence is made when an application or petition is missing the required documentation or evidence, or if USCIS needs more evidence to determine eligibility. The RFE states what evidence or information is needed for USCIS to fully evaluate your petition. The notice explains where to send the evidence and gives the deadline for response. The petition will be held in suspense during the time USCIS is awaiting your response.
