Manglona appoints Guam judge to mediate Saito’s suit vs UMDA

U.S. District Court for the NMI Chief Judge Ramona V. Manglona has appointed U.S. Magistrate Judge of the District of Guam Joaquin V.E. Manibusan Jr. to serve as a mediator/settlement judge in the lawsuit filed by a former chief financial officer of the United Micronesia Development Association Inc. against UMDA.

In an order issued last week, Manglona set the mediation settlement conference on April 25, 2012, at 10:30am at the U.S. District Court’s chambers conference room.

Manglona ordered former UMDA chief financial officer Hiroyuki Saito and UMDA to appear at the conference with their lawyers.

The judge directed the lawyers to file within 10 days of the completion of the conference a stipulated status report informing the court of the outcome of the mediation.

Manglona issued the order after Saito and UMDA, through their counsels, agreed to hold a conference to settle their disputes.

Saito and UMDA, through their respective counsels Mark A. Scoggins and Robert T. Torres, had asked the court to appoint Manibusan to be the mediator/settlement judge.

Saito is suing UMDA to compel the company to arbitrate their disputes. He claimed that UMDA’s total outstanding liability to him under the terms of the renewed contract is at least $975,000.

In February 2011, the federal court granted UMDA’s motion to dismiss Saito’s lawsuit but in May 2011, Saito filed an amended complaint. According to the amended complaint, UMDA terminated Saito’s employment effective immediately and without cause on Dec. 7, 2009.
