Judge dismisses woman’s criminal case

Superior Court Associate Judge Joseph M. Camacho has dismissed a criminal case filed against a woman who, while drunk, allegedly assaulted a man at her house in Garapan.

Camacho on Thursday dismissed without prejudice the criminal case charging Rowena A. Urumelog with assault and battery and disturbing the peace.

Dismissal without prejudice means the government is allowed to re-file a new case on the same claim in the future.

Camacho dismissed the case after the Office of the Attorney General asked the court to drop the case as the alleged victim and the only other witness have moved to Hawaii.

Without the alleged victim and the witness, the government cannot prove Urumelog’s guilt beyond a reasonable doubt, said government lawyer Darren Robinson.

“Should the victim and witness return, the Commonwealth may resume prosecution,” Robinson said.

Police detective Anthony Alepuyo stated in his report that a police officer responded to Urumelog’s residence in the afternoon of Jan. 28, 2012, after receiving a call about a fight.

Alepuyo said investigation showed that Urumelog had arrived home drunk and began shouting profanities at everyone in the house.

Ryan Cavalear told Urumelog to stop shouting because there are children in the house and that his wife is pregnant.

Urumelog allegedly started throwing clothes around, messing up the living room.

When Cavalear tried to call the police, Urumelog allegedly pushed him and then picked up a rock. Cavalear and Urumelog struggled for possession of the rock. After Cavalear managed to get the rock, he called the police.

When the incident happened, Urumelog was still waiting for her sentencing in federal court after being convicted of immigration document fraud.

Last Dec. 7, a federal jury found the 42-year-old Urumelog guilty of lying in her petition for her second husband, a Bangladeshi national.
