Judge puts off decision on bail change for sex abuse suspect

Superior Court Associate Judge David A. Wiseman has refused to issue a final ruling in the second motion to modify the bail being asked by a man who is charged with sexually abusing a 12-year-old girl on Tinian since she was 8 or 9 years old.

Wiseman said the bail modification being asked by John Ibanez Carreon, 41, will continue to be under advisement until the court receives further information about some concerns.

The judge noted is that it is necessary that all possible protections are in place to ensure that Carreon will not have any contact with children under 18 years old and that there is absolutely no direct or indirect contact with the alleged victim.

“This leads the court to its concern of the apartment building proposed for [Carreon’s] residence with the proposed third-party custodian,” Wiseman said.

Before the court can approve the place where Carreon will stay with his third-party custodian, Wiseman said that he would need an attorney’s written certification that there are no minors living in the building.

The judge found it strange that the third-party custodian will be renting the apartment for what appears to be the sole purpose of accommodating his role as a custodian.

Wiseman also noted another concern—that of security.

“The bail is $50,000, which the court deems necessary in view of the egregiousness of the charged offenses, the possible danger to the community, a possible flight risk and other factors,” Wiseman said.

Although Carreon proposes a 10 percent deposit of $5,000, Wiseman said there is still a balance of $45,000, which the court will require to be secured in a manner to show that in the event the bail is forfeited, the court will not be left with an empty bag and that the court has some realistic or viable chance to actually collect the $45,000.

Police arrested Carreon on Tinian last Jan. 25 after a concerned citizen reportedly called Tinian police two days earlier about a sexual abuse victim who wanted to die.
