Berline to issue subpoena for Tenorio

The defense lawyer in the case of a man who is accused of raping an intoxicated woman in 2016 would like to subpoena the previous prosecutor in the case, Teri Tenorio, who has already left the island.

Bruce Berline told Superior Court Presiding Judge Robert Naraja that he would like to summon Tenorio because she could be personally liable for prosecutorial misconduct.

This contradicts Berline’s statement in a status conference in March, when he said said it would not be necessary to subpoena Tenorio.

Tenorio left the island over a month ago after her contract with the Office of the Attorney General expired.

Berline asked the court to give him 30 days to summon Tenorio because it’s important that she responds.

Berline told the court that, at this point, it should not affect Manolo Romolor’s scheduled trial. Berline adds that he will continue to serve as Romolor’s lawyer pro bono.

The jury trial for Romolor will begin on May 13. The motions hearing has been continued to May 30 to allot Berline time to locate Tenorio and summon her.

Berline earlier asked the court to sanction Tenorio; he alleged prosecutorial misconduct. He told the court that the amount of time spent preparing and defending his client for a jury trial that ended in a mistrial last February led to the loss of over $1,000 in his fees.
