Guam ex-convict guilty of 1 charge, not guilty of 3 charges

A 49-year-old Guam ex-convict accused of impregnating a minor girl on Rota was found guilty of one count of travel with intent to engage in illicit sexual conduct by federal jury Tuesday.

The 12 jurors, however, found Melvin David Diaz not guilty of three counts of enticement of a minor.

The jurors handed their note to U.S. District Court for the NMI designated judge Frances Tydingco-Gatewood at 12:53pm about their unanimous verdict. The jurors began deliberations on Monday.

Judge Tydingco-Gatewood set the sentencing for May 14, 2012, at 10am.

Tydingco-Gatewood was to decide yesterday, Wednesday, Diaz’s request to hold the sentencing in Guam.

Assistant U.S. attorney Clyde Lemons Jr. said he has no problem with that.

According to the indictment, between Aug. 1, 2010, and Sept. 30, 2010, Diaz traveled from Guam to the CNMI for the purpose of engaging in illicit sex with the minor.
