Superior Court associate judge Joseph N. Camacho allowed yesterday the temporary release of a 32-year-old woman who allegedly attacked her husband with hot frying pan and burned his shoe.

Camacho modified his previous order that required Carmelita Guiao to post a $5,750 cash bail, allowing her to go free on a $5,750 in unsecured bond.

Camacho released Guiao to a third party custodian and imposed several bail conditions.

The judge said the court should take into account the nature and seriousness of the offense, character, associations, and community ties of the defendant, her bail record, and the strength of the evidence and other factors.

Camacho said the government does not consider Guiao a flight risk.

In the government’s opposition to bail modification, assistant attorney general Nicole D. Driscoll said that Guiao has not only demonstrated a disregard for the law, but she has shown a blatant disregard for the safety of citizens in the Commonwealth, specifically her own family.

“The defendant stands accused of acts that were unprovoked and very violent, made worse by the fact that they took place in the presence of four of her young children and also disturbed her neighbors,” Driscoll said.

Guiao was arrested for assault with a dangerous weapon, assault, and disturbing the peace.

The victim suffered burn marks on his arms.

Preliminary police investigation showed that the victim had arrived at their house and saw Guiao eating breakfast while their children have not been fed. The victim got upset and decided to cook breakfast for the children.

Guiao then repeatedly hit the husband with a hot frying pan. The victim tried to protect himself with his arms.

Guiao also allegedly set her husband’s shoe on fire and tried to flush the shoe down the toilet.

A police officer smelled a strong odor of alcoholic beverages in both Guiao and the victim.
