High Court rules against Guerrero

The Commonwealth Supreme Court has affirmed a Superior Court ruling that convicted former gubernatorial candidate Juan Guerrero of driving under the influence of alcohol.
In a ruling issued Monday, Nov. 28, in Commonwealth v. Guerrero, the Supreme Court determined that the evidence presented during Guerrero’s bench trial was sufficient to uphold his conviction.
The events leading up to Guerrero’s conviction began on the evening of March 4, 2010, when his SUV hit a sedan being driven by Chester Cuento along the northbound outer lane of Chalan Palé Arnold Road in Gualo Rai, Saipan. After interviewing both Guerrero and Cuento, and observing that Guerrero was displaying visible signs of intoxication, the officers at the accident arrested Guerrero, believing that he was driving under the influence of alcohol. After a bench trial, the trial court convicted Guerrero of driving under the influence of alcohol. Guerrero appealed, contending that there trial court lacked sufficient evidence to convict him.
