Man gets 30 days for assault

A man was ordered yesterday to spend 30 days in prison for beating up another man in Garapan in August this year.

Superior Court associate judge David A. Wiseman sentenced Nelson Anson Saimon to one year in prison, all suspended except for 30 days, for assault and battery.

Wiseman ordered the 23-year-old Saimon to start serving his sentence at the Department of Corrections on Jan. 3, 2012, at 8am.

After serving his sentence, Saimon will be placed on probation for two years.

Wiseman said the $500 fine will be reduced to $250 if Saimon pays the amount within one year of his release from prison.

The judge also required Saimon to pay $100 in court costs and probation fees, as well as costs of any medical fees associated with injuries to the victim.

Saimon pleaded guilty to assault and battery as part of a plea agreement.

The agreement stated that Saimon punched Aurelio Rayong in the face several times on Aug. 11, 2011, for embarrassing their race by eating food found in trash cans at the tourist district in Garapan.

Detective Catherine B. Pangelinan stated in her report that two police officers had responded to Coral Avenue in western Garapan on Aug. 11 at 11:37pm after the Department of Public Safety received a call about four men fighting in front of a hotel.

One officer spotted the victim, Rayong, walking toward a restaurant. His nose and left cheek were bloodied and his lips were swollen.

Police later arrested Alfonso Kintin and Saimon.

Police learned that Kintin had choked and repeatedly punched the victim. Saimon and another suspect joined in beating Rayong.

Pangelinan said that, according to the victim, Kintin, who was drunk, shouted at him that he was an embarrassment to their race because he would always eat food found in trash cans. The suspects and the victim are all Chuukese.
