Teenager gets 5-day jail term for rock throwing

A teenager who figured in a rock throwing with a friend during a drinking session at a house in Chalan Kanoa District 3 was given a five-day jail term.

Superior Court associate judge David A. Wiseman sentenced Darren Michael to six months in prison, all suspended except for five days, for assault—a lesser included offense of assault with a dangerous weapon.

In a written order issued last week, Wiseman gave the 18-year-old Michael credit for the time he already served in jail.

It means that Michael will no longer serve more jail term.

Wiseman placed the defendant on supervised probation for one year and required him to pay a $100 fine, $100 probation fee, and $25 court assessment fee.

The judge ordered the defendant to pay restitution to Roselle Carreon and also write a letter of apology to her for damaging her car.

During the probationary period, Michael is prohibited from consuming any alcoholic beverages. He was also required to submit to an examination focusing on anger management and alcohol/substance abuse at the Community Guidance Center.

The Office of the Attorney General charged the defendant with assault with a dangerous weapon, and minor consuming alcohol.

Michael signed a plea agreement with the government. He pleaded guilty to assault. The OAG dismissed the remaining charge as part of the plea bargain.

Detective Jonathan SN. Decena stated in his report that a police officer had responded to a residence in Chalan Kanoa on July 28, 2011 after receiving a call about a disturbance.

Decena said investigation showed that Michael and Tolove Bokuku got into a fight due to misunderstanding after they were drinking alcohol.

Michael threw a rock at Bokuku, but missed. Bokuku threw rocks back at Michael.

Detective Decena said that, while the police officer was talking with a witness, Michael started yelling and cursing at the officer. The officer arrested the teenager.
