Clothing storeowner, insurance company settle attorney’s fee
The owner of a clothing store in Garapan that burned down last year has settled the insurance company’s attorney’s fees.
Attorney Ramon K. Quichocho, counsel for Zheng Rui Brother Corp., notified the U.S. District Court for the NMI on Monday about the settlement they reached with FirstNet Insurance Co.
Last month, U.S. District Court for the NMI Chief Judge Ramona V. Manglona found Zheng Rui Brother Corp. liable to pay FirstNet Insurance Co. for the costs of filing a motion to compel Zheng Rui Brother to produce requested documents.
In granting FirstNet Insurance Co.’s motion to compel discovery, Manglona determined that FirstNet complied with the requirement of federal and local procedure rules to confer in good faith to obtain discovery without court action.
Manglona found that Zhen Rui Brother Corp. is liable to pay FirstNet with its costs in filing the motion.
Attorney Richard W. Pierce, counsel for FirstNet, said that 6.799 hours were spent in filing the motion to compel, costing $1,427.79.
On Oct. 30, 2010, a fire broke out at the BL Clothing Store owned by Zhen Rui Brother Corp.
In March 2011, the fire policy insurer, FirstNet, through counsel Richard W. Pierce, sued Zhen Rui Brother Corp. for allegedly deliberately setting off the fire so that the owner could claim $404,718.53 in insurance.
Zhen Rui Brother Corp later filed a counterclaim against FirstNet, alleging breach of contract, breach of implied covenant of good faith and fair dealing, insurance bad faith, and unfair or deceptive business practices.
