Settlement reached in lease dispute

A businessman and a landowner who filed a lawsuit and a counter-claim have agreed to settle a civil action filed in the U.S. District Court for the NMI.

Michael Dotts, counsel to Ting Jian Tang, also known as Kevin Tang, and Victorino DLG Torres, counsel for Ignatia C. Aldan, signed Tuesday a stipulated dismissal with prejudice, which means the case cannot be re-opened.

The two parties agreed to bear their own attorneys fees and costs and that the court shall retain jurisdiction to enforce the settlement agreement entered into by the parties.

In February, businessman Tang sued Aldan for breach of contract, unjust enrichment, unlawful conversion and fraud and asked the federal court to order Aldan to pay him in unspecified amount of damages, attorney’s fees, and court costs.

Aldan allegedly breached a memorandum of understanding that she and Tang entered into on April 24, 2009. Saipan Tribune files show that under the MOU, Aldan agreed to lease her property to Tang for 55 years in exchange for a proposed renovation and remodeling work on Mary’s Bakery worth $98,675 plus an additional $10,000 in cash to be paid by Tang.

Tang did the renovation and remodeling work on Mary’s Bakery and provided furnishings worth $98,657. In late September 2009, Tang learned that the property had already been leased to Lee Kwang Suk on June 19, 2009.

In March, landowner Aldan counter-sued Tang for breach of contract for not completing the scope of work in renovating Mary’s Bakery.
